The Pain-Capable Unborn Child Protection Act OH/WV



Today in the United States, abortion is legal through all nine months of pregnancy for any reason, including gender selection in some states!

Approximately 3,000 unborn children are aborted (killed) every day in this Country, where the writers of our Declaration of Independence pledged,

“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain inalienable rights, that among these are Life…”

Last month, the WV Senate voted 27 to 5 to override Governor Tomblin’s veto of the Pain-capable Unborn Child Protection Act, making West Virginia the 11th state to pass this historic legislation. The House had also voted to override the Governor’s veto 77-16.

The Pain-Capable Unborn Child Protection Act, HB 2568, which earlier had passed 88-12 in the House (2/11/15) and29-5 in the Senate (2/25/15), had been vetoed on March 3, by Governor Earl Ray Tomblin based on misguided advice about the constitutionality of the bill.

Earlier in the session, during both House and Senate committee meetings, National Right to Life’s Attorney Jennifer Popik testified that similar legislation is in effect in eight states, is being litigated in two, and has not come before the Supreme Court for a determination regarding its constitutionality.

Because bi-partisan support was so overwhelming with 2/3’s of the Democrats initially supporting the bill in both Republican-controlled chambers, West Virginians for Life expected this outcome.

“West Virginians can be proud of their legislative representatives for the hard work they put into the effort to protect unborn children from the terrible pain of abortion,” said John Carey, Legislative Coordinator for WVFL. “They truly represented the pro-life values of the state.”

“We applaud the passage of HB 2568. This bill reflects the most current medical research, which clearly demonstrates that human beings feel pain beginning at least by 20 weeks gestation,” added West Virginians for Life President Wanda Franz. “West Virginia children will now be protected from pain and abuse from the beginning of the time that they are capable of suffering from pain.”

Last month Ohio Right to Life’s premier legislation for 2015 was introduced in the Ohio House of Representatives and Senate. The Pain-Capable Unborn Child Protection Act (H.B. 117 and S.B. 127) prohibits abortions in Ohio at the point at which pre-born babies can feel pain, which is as early as 20 weeks gestation. The legislation is sponsored by Representatives Kristina Roegner and Bob Cupp and Senators Peggy Lehner and Jay Hottinger. Thirty-three legislators signed on as co-sponsors of the legislation.

“The outpouring of support that we have received for this legislation goes to show that Ohio is ready and eager to catch up with the rest of the developed world by affirming the humanity of the unborn,” said Stephanie Ranade Krider, executive director of Ohio Right to Life. “We are hopeful that with this legislation we will be able to welcome more and more voices into our movement, showing that the right to life really is a bipartisan issue that everyone has a stake in.”

“Human growth in the womb is truly amazing,” said Dr. Dennis Sullivan, director of the Center for Bioethics at Cedarville University. “Most fetal organs are fully formed by the end of the first three months of development. We also know that unborn babies react to external stimuli very early on, and pull away from probes and operating instruments when procedures are done late in pregnancy. I am so thankful that society is finally recognizing the need to protect its most vulnerable members from unnecessary and horrific pain and suffering. It is our solemn duty to pass the Pain-Capable Unborn Child Protection Act.”

Indeed Psalms 139 says:

13 For You formed my inward parts;
You covered me in my mother’s womb.
14 I will praise You, for I am fearfully and wonderfully made;
Marvelous are Your works,
And that my soul knows very well.
15 My frame was not hidden from You,
When I was made in secret,
And skillfully wrought in the lowest parts of the earth.
16 Your eyes saw my substance, being yet unformed.
And in Your book they all were written,
The days fashioned for me,
When as yet there were none of them.

What really gets me is the fact that premature babies can routinely be saved at 21 to 22 weeks after fertilization, and sometimes they can be saved even younger.  So if the unborn baby at this point is considered to be viable in the living world then why would any mother choose to take away the life of her own child clear up to 9 months of pregnancy? Not to mention killing her child before 20 weeks gestation.
